This End User License Agreement ("EULA") is a legal agreement between you and the developer of SepticTrack ("we", "us", "our") for the SepticTrack mobile application and any updates, content, and services it includes (the "Application"). By downloading, installing, or using the Application you agree to this EULA. If you do not agree, do not use the Application.
This EULA governs your license to use the Application. Your broader use of the Application and our website is also covered by our Terms of Use and Privacy Policy; where a specific purchase or subscription question arises, the Terms of Use control.
1. Acknowledgement
This EULA is concluded between you and us only, and not with Apple Inc. or Google LLC (each a "Store"). We, not the Store, are solely responsible for the Application and its content. The Store has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.
2. Scope of license
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your own non-commercial purposes on any Apple-branded or Android device that you own or control, as permitted by the Usage Rules in the applicable App Store or Google Play terms of service. You may not rent, lease, lend, sell, redistribute, sublicense, copy (except as expressly permitted), modify, translate, reverse-engineer, decompile, or disassemble the Application, or create derivative works of it, except to the extent that this restriction is prohibited by applicable law.
3. Purchases & subscriptions
SepticTrack is free to download. SepticTrack Plus unlocks premium features through a $9.99 per year auto-renewing subscription, billed by the store. Full purchase, renewal, and cancellation terms are in the Terms of Use.
4. Maintenance and support
We are solely responsible for providing any maintenance and support services for the Application, as described in this EULA, the Terms of Use, or as required by law. You can reach us at support@septictrack.app or via the support page. The Store has no obligation to furnish any maintenance or support services.
5. Warranty
The Application is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, to the maximum extent permitted by applicable law. In the event of any failure of the Application to conform to any applicable warranty, you may notify the Store, and the Store may refund the purchase price of the Application to you (if any). To the maximum extent permitted by law, the Store will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
6. Product claims
We, not the Store, are responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of it, including but not limited to: (a) product liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit our liability beyond what is permitted by applicable law.
7. Intellectual property
The Application and all worldwide intellectual property rights in it are and remain our property (or that of our licensors). This license does not transfer any ownership. In the event of any third-party claim that the Application or your possession and use of it infringes that third party's intellectual property rights, we, not the Store, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by this EULA.
8. Your content
Records, photos, and notes you create in SepticTrack are yours; we claim no ownership. They are stored on your device and handled as described in our Privacy Policy. You are responsible for the content you store and export.
9. Reminders & disclaimers
- Notification delivery depends on your device settings, OS behavior, and permissions and is not guaranteed. Do not rely on the Application as your only safeguard for time- or safety-critical maintenance.
- Schedules and estimates are approximations based on your inputs and common guidance; actual conditions vary.
- Pumping intervals are rule-of-thumb estimates. Always follow local regulations and your septic professional's advice.
10. Legal compliance
You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms of agreement when using the Application (for example, your wireless data service agreement).
11. Termination
This license is effective until terminated by you or by us. Your rights under this EULA terminate automatically, without notice, if you fail to comply with any of its terms. Upon termination you must stop using the Application and delete all copies. You may terminate at any time by deleting the Application and, if you created an account, using Settings → Delete account (see Delete account & data).
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or property arising from your use of (or inability to use) the Application. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$25. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Third-party beneficiary
You acknowledge and agree that the relevant Store, and its subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of this EULA, that Store will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.
14. Changes
We may update the Application and this EULA. If a change is material, we will revise the effective date above and note it in release notes. Your continued use of the Application after a change takes effect means you accept the updated EULA.
15. Governing law
This EULA is governed by the laws applicable in your country of habitual residence, without depriving you of any mandatory consumer protections available to you there.
