These Terms of Use ("Terms") are an agreement between you and the developer of SepticTrack ("we", "us") covering your use of the SepticTrack mobile app and this website (together, "the Service"). By using the Service you agree to these Terms. Your license to install and run the app is set out separately in our End User License Agreement (EULA); where the two documents overlap, the EULA governs the software license and these Terms govern everything else, to the extent permitted.
1. What SepticTrack is
SepticTrack is a personal tracking and reminder tool for septic care. It records what you tell it and reminds you based on schedules and estimates. It is an organizational aid — not a professional, medical, safety, insurance, or engineering service.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, subject to these Terms and the store's rules. You may not copy, modify, distribute, sell, lease, reverse-engineer, or extract source code from the Service except where the law permits it despite this restriction.
3. Purchases & subscriptions
SepticTrack Plus ($9.99 per year)
- Auto-renewal: payment is charged to your App Store or Google Play account at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
- Managing & cancelling: subscriptions are managed by the store, not by us — use your Apple subscription settings or Google Play subscription settings. Deleting the app does not cancel a subscription.
Refunds are handled by the store you purchased through (Apple or Google) under their policies; we cannot issue store refunds directly. Restoring: use "Restore purchases" in the app's Settings with the same store account.
4. Your content
Photos, notes, and records you create in SepticTrack are yours. They are stored on your device; we claim no ownership and gain no rights to them beyond what's needed to operate features you invoke (e.g., rendering an export you request).
5. Acceptable use
Don't misuse the Service: no unlawful use, no attempting to break, overload, or probe our infrastructure, no infringing others' rights with content you store or export.
6. Reminders, estimates & disclaimers
- Notifications depend on your device settings, OS behavior, and permissions — delivery is not guaranteed. Do not rely on the Service as your only safeguard for time-critical or safety-critical maintenance.
- Schedules and level estimates are approximations based on your inputs and common guidance; actual conditions vary.
- Pumping intervals are rule-of-thumb estimates. Always follow local regulations and your septic professional's advice.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or property arising from your use of (or inability to use) the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$25. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you.
8. Termination
You can stop using the Service at any time; deleting your account in Settings removes your server-side data (see Delete account & data). We may suspend or end the Service or your access to it if you break these Terms or if we discontinue the app, and where required we'll give reasonable notice.
9. Changes
We may update the app and these Terms. If a change is material, we'll update the effective date and note it in release notes. Using the Service after a change means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws applicable in your country of habitual residence, without depriving you of any mandatory consumer protections there.
